No, not in the universe of DMC. People who live in hell are not departed. Dante and most of the other characters have been in hell, but they have not died. Departed means literally dead.

rebellion to pin him to the floor so as to give him time to get away

happier to do away wit him since it was his father that brought him
into his present condition,but he cold not so he brainwashed him.Dante
in dmc1 only destroyed the influence of mundus over vergil,so rit now

The story of DMC2 is completely irrelevant with DMC3's and 1's storyline, so don't base your assumptions on that. And what makes you think the Sons of Sparda can't be killed? Yes they can, even though they will take a lot more punishment than a normal human. And it is just a popular assumption that Mundus brainwashed Vergil, not a confirmed fact. In the light of the new information, Mundus may have actually killed Vergil, and used his soul to create Nelo Angelo. So we could say that Nelo Angelo is just Vergil's "ghost in the shell".
